HLG Settles Claim Against Sellers for Misrepresenting Size of Building / January 01, 2010

HLG's client purchased a commercial building on historic Larchmont Boulevard. The sellers represented that the building was 4336 square feet. After the sale, the buyer discovered that the actual size of the building was 4000 square feet. HLG sued the seller for breach of contract, mutual mistake and fraud. The seller contended that it gave buyer the "approximate" size of the building, and that the buyer elected to purchase the building without doing a property inspection. Notwithstanding seller's contentions, HLG successfully settled the case for $250,000 without the expense of any motions or discovery for its clients.
