HLG Wins 30-Day Arbitration!
/ November 18, 2010
On October 14, 2010, after a 30-day arbitration spanning twelve months in New Jersey, Huron law group obtained an award for its client, Noelle Hale. In 2005, Ms. Hale formed a limited liability company and invested money with Desiron, a furniture manufacturer, to open a showroom in Beverly Hills, CA. Ms. Hale lost her investment when the Beverly Hills showroom failed less than two years later.
Desiron filed a demand for arbitration against Ms. Hale, alleging that the Beverly Hills showroom failed because of Ms. Hale’s inexperience and inattention to the showroom. Desiron sought unreimbursed expenses and other damages. Ms. Hale filed a counter-demand, claiming that Desiron and its founder, Frank Carfaro, made several misrepresentations and omitted several facts regarding the investment.
In a twenty-eight-page decision in Ms. Hale’s favor, the arbitrator found that Desiron made several misrepresentations and omissions to induce Ms. Hale to invest and ordered the return of her investment. The arbitrator also rejected all of Desiron’s claims.
