HLG Wins Dismissal of Breach of Fiduciary Duty Suit Against Broker

The plaintiff sued HLG's client, a real estate broker, for breach of fiduciary duty and negligence. Plaintiff's complaint alleged that the broker failed to list the property for sale. HLG established that plaintiff did not have a written listing agreement with the broker as required by California law. The court granted HLG's motion for judgment on the pleadings without leave to amend and dismissed plaintiff's suit.
