HLG Wins Dismissal of TILA Suit Against American General Mortgage Corp.
/ February 01, 2010
A federal district court granted an order dismissing HLG's client American General Mortgage Corporation ("AGMC") with prejudice from claims relating to mortgage origination and servicing.
The plaintiff sued AGMC for violation of the Truth In Lending Act and Real Estate Settlement Procedures Act, as well as for state law claims. HLG Attorney Janis Hui prevailed on two successive motions to dismiss plaintiff's complaint on the grounds that plaintiff's claims were barred by the statute of limitations and failed to allege any recoverable damages. In granting the second motion to dismiss, the federal district court denied plaintiff leave to amend and dismissed the suit with prejudice.
